The church and its Property
G-8.0101
The provisions of section G-8 of Decisions this Constitution prescribing the Regarding manner in which decisions are Property
made, reviewed, and corrected
within this church are applicable
to all matters pertaining to
property.
G-8.0201 All property held by or for a Property
is particular church, their respective Held in
Presbytery, their Primary Synod Trust (either
Westminster or Auburn),
and the Presbyterian Church (U.S.A.),
whether legal title is lodged in a corporation,
a trustee, or trustees,
or an unincorporated association,
and whether the property is used in
programs of a particular church, or
retained for the production of
income, is held in trust nevertheless for
the use and benefit of the
Presbytery Church (U.S.A.) and the
Primary Synod (Auburn or Westminster)
with which the congregation is
aligned.
G-8.0202 Incorporation Whenever permitted by civil law, each and
Trustees respective Presbytery, and the Primary Synod
with which the congregation and
respective Presbytery are aligned
(Westminster or Auburn), shall cause
a corporation to be formed and
maintained. The council of the
governing body shall constitute the
Board of Trustees of the corporation
unless the governing body shall
determine an alternative method
to constitute the Board of
Trustees.
G-8.0301 Whenever property of, or held Property
for, a particular church of the Used
Presbyterian Church (U.S.A.) Contrary to ceases to be used by that Constitution
church as a particular church
of the Presbyterian Church (U.S.A.)
in accordance with this Constitution,
such property shall be held, used,
applied, transferred, or sold as determined
by their respective
Presbytery and the Primary Synod
(Westminster or Auburn)
with which the congregation and
the Presbytery are aligned.
G-8.0401 Whenever a particular
church is Property of formally dissolved by their Church
respective Presbytery, aligned Dissolved with the same Primary Synod or Extinct as the congregation (Auburn
or Westminster), or the
congregation has become
extinct by reason of the
dispersal of its members,
the abandonment of its work,
or othre cause, such property
as it may have, shall
be held, used, and
applied for such uses, purposes, and
trusts, as their respective
Presbytery, aligned with with
same Primary Synod as the congregation,
(either
Westminster or Auburn),
may direct, and appoint, or
have such property sold
or disposed
of by their respective
Presbytery aligned with the
same Primary Synod as
the congregation (Auburn
or Westminster), as the
respective Presbytery
may direct, in accordance
with the guidelines of their
Primary Synod (Westminster
or Auburn).
G-8.0501 A particular church shall not Selling or sell, mortgage, or otherwise Encumbering encumber
any of its real estate Church and it shall not
acquire real Property property subject to an
encumbrance or condition
without the written permission
of their respective Presbytery,
aligned with the same Primary
Synod as the congregation
(Auburn or Westminster).
This request for permission shall
be transmitted through
the session of the particular
church to their respective
Presbytery.
G-8.0502 A particular church shall not
Leasing lease its real property used Church for
purposes of worship, or Property lease for more than
five years any
of its other real property,
without the written permission
of their respective Presbytery
aligned with the same Primary
Synod (Westminster or
Auburn) as the congregation. The
request shall be transmitted
through the
session of a particular church to their
respective Presbytery.
G-8.0601 The relationship of
a congregation Property of to the Presbyterian Church (U.S.A.), Church
in and to its Primary Synod, Schism
(Auburn or Westminster),
with which it is aligned, can be severed only
by constitutional action
on the part of their
respective Presbytery aligned
with the same Primary Synod
(Westminster or Auburn) as the
congregation. If there is a
schism within the membership
of a particular church and their
respective Presbytery, aligned with
the same Primary Synod
as the congregation (Westminster
or Auburn), is unable to effect
a reconciliation or a division into
separate churches within the
Presbyterian Church (U.S.A.), that
respective Presbytery shall determine
if one of the factions is entitled to the
property because it is
identified by their respective
Presbytery, aligned with the same
Primary Synod as the congregation,
(Auburn or Westminster), as the true church
within the Presbyterian Church (U.S.A.).
This determination does not depend
upon which faction received the
majority vote within the particular
church at the time of he schism.
